Quoted prices, either verbal or in writing, are good for 5 days unless otherwise specified. Unless otherwise expressly stated, all prices exclude state, county and/or local taxes. Your tax rate will be calculated based on the delivery location of the product and added to the invoice unless a current tax exempt certificate is on file.
Credit and Terms of Payment
All accounts are COD or pre-paid unless credit has been applied for and approved by WW accounting department. On those accounts to which credit has been extended, all invoices are due and payable 30 days from the invoice date. A 50% downpayment is required on fi rst order for all new customers. Interest of one and one-half percent (1.5%) per month from the due date will be added to all accounts more than 60 days past due. Any goods that have been ordered on open account and are not delivered within 30 days of completion will be invoiced at that time with 30-day terms commencing from the invoice date.
Custom Products
Custom or non-standard tanks, vessels or other products may require a 50% deposit to commence production.
Storage Fees
If after 30 days from completion of product, undelivered products may will incur a storage fee until which time the customer takes delivery of the products.
Delivery, Oversize Loads and Permits
All goods are sold F.O.B. shipping point unless expressly stipulated otherwise. In most cases, WW will deliver and set the customer’s tanks and stair/walkway on WW’s fleet of crane trucks. Delivery quotes are based on best estimates of mileage to the customer’s location based on the shortest route available. Oversize loads may require routes that are not the shortest distance and may be unknown until each state’s permit office has issued a route. Any additional mileage and required oversize permits will be added to the shipping invoice. Any changes to delivery location that require additional travel distance will be added to the invoice. The price of setting is not included in the delivery charge unless otherwise stated in the quote or order. If setting time exceeds 3 hours due to delays beyond WW’s control, an hourly charge will be applied to the invoice.
Return Goods
No WW products or parts can be returned for credit unless consent of WW in writing has been given in advance. Goods returned must be identified as to the original date of purchase and clearly show the shipper’s name and address. Goods not returned in salable condition may be subject to a deduction equal to the charges necessary to make the goods salable. Any freight paid by WW will be deducted from the amount of credit granted.
Force Majeure
WW shall not be liable for any failure to perform or delay in performance of this Agreement to the extent that any such failure arises from acts of God, war, civil insurrection or disruption, riots, government act or regulation, strikes, lockouts, labor disruption, cyber or hostile network attacks, inability to obtain raw or finished materials, inability to secure transport, or any cause beyond such party’s commercially reasonable control.
Claims
When goods are not delivered by WW trucks and personnel, WW is not responsible for goods lost or damaged in transit. Purchaser is solely responsible for filing claims against the carrier for any loss or damage. WW will furnish all possible information, trace shipments to destination whenever possible, and render any other reasonable assistance requested to assist purchaser in filing his claim.

Warranty
WW warrants its tanks to be free from defects in manufacturing, workmanship or materials for the period of one year from date of shipment. If a product or part should be found to be defective, notice should be given to WW immediately. WW will repair or replace at its sole discretion, within a period of one year after date of shipment, any tank proven to be defective. WW reserves the right to inspect and test the defective item. The defective part should be retained until notice is received from WW as to its disposition. Liability hereunder is limited to repair or replacement and does not include labor, installation costs, or indirect or consequential damages of any nature. The warranty obligations apply only when products or parts are used for the purpose and under the conditions for which they are intended, and in accordance with the best-accepted installation and operation practices and techniques.
WW warranties apply only to goods manufactured by WW. Goods not manufactured by WW are warranted and guaranteed only to such an extent as these products and parts are warranted and guaranteed by the manufacturer or supplier of such goods and parts and then only to the extent WW is able to enforce such warranty or guarantee. The foregoing constitutes the entire obligation of WW Tank Vessel, and there are no express or implied warranty of merchantability or fitness for any purpose whatsoever, except as stated above.
Miscellaneous
Where the customer requests special tests or inspections in excess of the regular factory inspections, the actual cost of such tests or inspections shall be charged to the customer unless prior agreements are made. W&W Fiberglass Tank Co. is not responsible for non-delivery or delay in delivery due to delays, damages or losses resulting from strikes, riots, fires, floods or other accidents or occurrences beyond the control of WW. Prices, specification and terms, as contained in any WW catalog or bulletin, are subject to change without notice.
